The Government issued Decision 40/2021/QD-TTg, which stipulates the amounts of support for employees from the Overseas Employment Support Fund from 21 February 2022.

The Government issued Decision 40/2021/QD-TTg, which stipulates the amounts of support for employees from the Overseas Employment Support Fund from 21 February 2022.

The support amounts from the Overseas Employment Support Fund for employees working abroad under contracts are as follows:

(1) If they are forced to return home earlier than contracted due to a work accident, accident, illness or disease to the extent that they are no longer possible to continue working abroad. (Article 10 Decision 40/2021/QD-TTg).

The support amount is from 10,000,000 VND to 30,000,000 VND/case.

(Currently, the amount of support is 5,000,000 VND/case) 


(2) Supporting relatives of workers who die or go missing while working abroad. (Article 14 Decision 40/2021/QD-TTg). 


The support amount is 40,000,000 VND/case.

(Currently, the amount of support for relatives of employees who die while working abroad is 10,000,000 VND/case) 


(3) In case the employee is forced to return home early because the oversea employer is dissolved, bankrupt or downsized production due to natural disasters, epidemics, political instability, war, economic recession or because of force majeure. (Article 11 Decision 40/2021/QD-TTg)

The support amount is from 7,000,000 VND to 20,000,000 VND/case.

(4) In case the employee is forced to return home early due to unilateral termination of the labor contract when the employer abuses, forces labor or has a clear and direct threat to the employee life, health or sexual harassment while working abroad. (Article 12 Decision 40/2021/QD-TTg). 

The support amount is from 7,000,000 VND to 20,000,000 VND/case. 

(5) In case a dispute arises related to the employee in the operation of sending workers to work abroad under the contract. (Article 13 Decision 40/2021/QD-TTg)


+ Support employees with costs of hiring lawyers, legal counsel, court fees to settle cases:

The support amount is equal to 50% of the cost of hiring lawyers and consultants. legal advice, legal fees but maximum VND 50,000,000/case; If the case involves many employees, the maximum support amount is 100,000,000 VND/case.

+ Support to rent temporary accommodation for employees according to the decision of the competent authority during the time of settlement of labor contract disputes with the employer and the employee is not able to arrange accommodation.

The support is equal to 100% of actual costs according to invoices and documents of renting accommodation for employees.

(6) Support for change job for employees. (Article 15 of Decision 40/2021/QD-TTg)

Employees must return home before the due date in the following cases (1), (3), (4) and have the need to be trained for change job will receive financial support to raise vocational skills to participate in the labor market and stabilize life.

The support amount is 1,000,000 VND/month, maximum 06 months/person/course.

Currently, Decision 144/2007/QD-TTg does not specify support amounts (3), (4), (5), (6) but only provides support for some other objective risk cases decided by the Minister of Labour, Invalids and Social Affairs at the proposal of the Fund Management Council but not exceeding VND 5,000,000/case. 

Decision 40/2021/QD-TTg takes effect from February 21, 2022 and replaces Decision 144/2007/QD-TTg.
