Increase in standard working time and overtime for seasonal employees from 01 February 2022

On 15 December 2021, the Ministry of Labor, War Invalids, and Social Affairs issued Circular No 18/2021/TT-BLDTBXH to give guidance on the working time and rest time for employees doing seasonal-producing work and processing of goods under purchase orders, in which there is a regulation to increase the On 15 December 2021, the Ministry of Labor, War Invalids, and Social Affairs issued Circular No. maximum number of working hours and overtime.

Some notable contents are as follow:

-    The total number of standard working hours and working overtime hours in a day must not exceed 12 hours.

-    The total number of standard working hours and working overtime hours in a week must not exceed 72 hours. (Currently 60 hours/week)

-    The total number of working overtime hours in a month must not exceed 40 hours. (Currently 32 hours/month)

-    The total number of working overtime hours in a year must not exceed 300 hours.

In case the employer decides to implement the regime of working time and rest time according to this Circular, the employer shall prepare the plan of working hours and rest periods in the year as specified in Clause 2, Article 8 of Circular 18/2021/TT-BLDTBXH. 

Circular 18/2021/TT-BLDTBXH shall takes effect on 01 February 2022 and replaces Circular 54/2015/TT-BLDTBXH dated 16 December 2015.
